REGULATION
1.OBLIGATION OF ORGANIZER
The organizer undertakes to ensure that exhibition will take place at Beijing (China) on the dates planned. Should the exhibition fail to be held on time or at the premises planned due to force majeure including governmental interference, natural calamities, etc., the organizer will have rights to organize the said exhibition on another date in different premises in Beijing or another city in China, in which case the exhibitor will have no right to oppose such changes or to claim damages if such a change is in the interests of the exhibition itself, in view of its purpose and so on, and if the organizer has given written notice to the exhibitor no later than one month before the opening date;
If it still proves impossible to make the above changes, the organizer will have the right to cancel the exhibition outright, having first notified the exhibitor. In this case, this EXHIBITOR CONTRACT will be legally terminated. Any money remaining from payment by the exhibitors, after covering the costs incurred by the organizer, will be distributed to the exhibitors, and they will have no claim of any kind against the organizer in this respect, each exhibitor expressly accepts this as an essential condition of the contract.
2.Responsibilities of EXHIBITOR
2-1. The party participating in exhibition shall observe the specifications in the EXHIBITOR CONTRACT and in the Exhibitor’s Manual for 2007BIBF (it will be subsequently delivered to each exhibitor) and should obey organizers’ unanimous arrangements.
2-2. Should the party participating in exhibition not pay the charges for the exhibit space before March 31, 2007, the Organizer shall not guarantee the exhibit space reserved by it.
2-3. This agreement (EXHIBITOR CONTRACT) will be legally valid on signature of this contract and it is definitive and irrevocable. In the case of cancellation, on any date or for any reason except force majeure, such as warfare, natural disaster, plague, etc., the signatory to this EXHIBITOR CONTRACT will remain liable for reimbursement which is equal to the cost of raw space reserved in the contract to the organizer. In the case of changing from package booth(s) to raw space, on any date or for any reason, the signatory to this EXHIBITOR CONTRACT will remain liable for reimbursement which is equal to the cost of booth putting up reserved in the contract to the organizer.
The fees of renting exhibit space must be paid in the same conditions as mentioned in the pamphlet and in the Exhibitor’s Manual for 2007BIBF.
2-4. The exhibit space rented by any organization or person shall not be transferred to others or used by the company with its (brand) name not having been registered for exhibition. Should any such occasions occur, exhibition organizer will be granted with the right to refuse the company to participate in the exhibition.
3.DIRECTORY OF BIBF
The party participating in exhibition should submit the EXHIBITOR CONTRACT and information to be publicized to exhibition organizer before March.31, 2007. Should the exhibitor not manage to send its EXHIBITOR CONTRACT to the organizer in time, the organizer shall not ensure to publish exhibitor’s information into the directory widely spread for the exhibition.
4.SAFETY AND SECURITY
4-1. The party participating in exhibition shall guarantee its and its staffs’ behavior to be in conformity with the regulations of local laws and rules, to observe public rules and to take care of the matched facilities provided by organizer. Should any disputes and damages caused by the party participating in exhibition and its staffs, it will bear all responsibilities.
4-2. In addition to the insurance covering products and objects exhibited, and in general all movable or other objects belonging to him, the exhibitor is suggested to arrange, at his own expense, for all insurance covering the risks to himself and his staff, and to third parties. It is understood that the organizer has no responsibility in this area.
5.NOTICE TO EXHIBITOR
The Exhibitor’s Manual for 2007BIBF published by organizer has the equally authentic legality as the EXHIBITOR CONTRACT.
6.ONLINE CONTRACT
The online contract through the official website (www.bibf.net) submitted by exhibitor will has the equally authentic legality as this EXHIBITOR CONTRACT.
7.PENALTIES
Should any damages the organizer suffer due to exhibitors’ infringing agreements and regulations as stipulated in the EXHIBITOR CONTRACT and in the Exhibitor’s Manual for 2007BIBF, the organizer will be granted with right to claim compensation for its losses.
8.APPLICABLE LAW AND ATTRIBUTION OF JURISDITION
The sponsor of this exhibition and the implementation of this contract are applicable for the laws of the People’s Republic of China. The REGULATION in Chinese version will be the only legally valid version. Should any disputes arouse concerning the interpretation and execution of this contract, the local court, where the exhibition is located will be regarded as the only instance jurisdictional court.
